Regulations of the online shop 

Clause 1 Introductory provisions

“Sacred Enquiry” online shop, available at https://www.sacredenquiry.com, is run by Radosław Skonieczny who conducts business activity under business name Motionverse Radosław Skonieczny, entered in the Central Registration and Information on Business (CEIDG) kept by the minister competent for economy, Tax ID No. (NIP) 9562259044, National Business Registry No. 365924224.

These regulations are addressed to Consumers and set out the principles and mode of the conclusion of a distance Contract of Sale with a Consumer via the Shop.

Clause 2 Definitions

  1. Consumer – a natural person entering into a contract with the Seller as part of the Shop which object is not directly related to business or professional activity.
  1. Seller – a natural person conducting business activity under business name Motionverse Radosław Skonieczny, entered in the Central Registration and Information on Business (CEIDG) kept by the minister competent for economy, Tax ID No. (NIP) 9562259044, National Business Registry No. 365924224.
  1. Customer – every entity making purchases via the Shop.
  1. Shop – an online shop run by the Seller at sacredenquiry.com
  1. Distance contract – a contract entered into with a Customer as part of an organised system of the conclusion of distance contracts (as part of the Shop), without simultaneous physical presence of the parties, with the exclusive use of one or more means of distance communication up to and including the time at which the contract is concluded.
  1. Regulations – these regulations of the Shop.
  1. Order – a Customer’s statement of will submitted through an Order Form and directly aimed at the conclusion of a Contract of Sale of a Product or Products with the Seller.
  1. Account – a Customer’s account in the Shop, details provided by a Customer and information on orders placed by a Customer in the Shop are collected in it.
  1. Registration form – a form available in the Shop, allowing to create an account.
  1. Order form – an interactive form available in the Shop enabling placing an Order, in particular by adding Products to a Shopping Cart and setting out terms and conditions of a Contract of Sale, including a delivery and payment method.
  1. Shopping cart – an element of software of the Shop in which Products chosen by a Customer for purchase are visible, and in which it is possible to set and modify details of an Order, in particular the quantity of products.
  1. Product – movable property/service available in the Shop being an object of a Contract of Sale between a Customer and the Seller.
  1. Contract of Sale – a contract of sale of a Product concluded or being concluded between a Customer and a Seller via the online Shop. A Contract of Sale shall also be understood as – in accordance with qualities of a Product – a service agreement and a contract for specific work.

Clause 3 Contact with the Shop

  1. A Customer may communicate with the Seller by post or electronic mail, to the addresses indicated in this Clause.

Clause 4 Technical requirements

The following is required to use the online Shop:

  1. connection to the Internet (with any bandwidth),
  1. one of web browsers (e.g. Internet Explorer, Mozilla, Chrome, etc.) allowing to display hypertext documents (HTML) on a computer screen,
  1. email account,
  1. enabled support for Cookies.

Clause 5 General Information

  1. To the fullest extent permitted by law, the Seller shall not be liable for any disruptions of, including interruptions in, the functioning of the Shop caused by force majeure, unauthorised actions of third parties or the incompatibility of the online Shop with Customer’s technical infrastructure.
  1. Browsing the product range of the Shop does not require setting up an Account. Placing orders by a Customer for Products available in the product range of the Shop is possible either after setting up an Account in line with the provisions of Clause 6 of the Regulations or after providing personal data and address details allowing to carry out an Order without setting up an Account.
  2. Prices in the Shop are indicated in EURO and are gross prices (they include VAT).

Clause 6 Setting up an Account in the Shop

  1. To set up an Account in the Shop, fill in a Registration Form. It is necessary to provide the following details: first name, surname, email address, login, password.
  1. Setting up an Account in the Shop is free of charge.
  1. Logging on to an Account takes place after providing a login and a password indicated in a Registration Form.
  1. A Customer may at any time, without giving any reason and bearing any fees on this account, delete his/her Account by sending a relevant request to the Seller, in particular via electronic mail or in writing to the addresses indicated in Clause 3.

Clause 7 Principles of placing an Order To place an Order it is necessary to:

  1. log on to the Shop (optional),
  1. choose a Product being the object of an Order, next, click the button “To the cart” (or equivalent),
  1. log on or use the possibility of placing an Order without registration,
  1. if the possibility of placing an Order without registration was chosen, fill in an Order Form by entering details of the recipient of an Order and an address to which a Product is to be delivered, chose type of consignment (Product delivery method), enter details for an invoice if they are different than the details of the recipient of an Order,
  2. click the button “I order and pay” / click the button “I order and pay” and confirm an order by clicking a link sent in an email message,
  1. choose one of the available payment methods and depending on a payment method, pay for an order by a set deadline, subject to Clause 8(3).

Clause 8 Offered delivery and payment methods

  1. A Customer may use the following delivery methods:
    1. Poczta Polska Polish postal service,
    1. courier service.
  1. A Customer may use the following payments methods:
    1. prepayment in the PayPal system (it means that payment will be made online via the PayPal system, and the parcel will be sent after confirmation of the receipt of the payment)

Clause 9 Fulfilment of an order

  1. Lead time (from the moment of obtaining a positive authorisation of payment to delivery): 7 – 21 days on average.
  1. The lead time may be subject to change. In such a case a Customer will be notified about this fact.
  1. Please indicate precise address and phone number to allow fulfilment of an order. We kindly ask you to carefully check contact details.

Clause 10 The right to withdraw from a contract

  1. A Consumer may within 14 days withdraw from a Contract of Sale and return ordered goods without giving any reason within 14 days from receiving it, provided that the product was not used. It shall be sent to our address with a proof of purchase. We guarantee return of money within 14 days from the moment of receiving the return. A Customer making the return bears shipping cost.
  1. The declaration can be made using a form which model was provided by the Seller on the Website of the Shop at: Withdrawal form
  1. In case it is necessary to return funds for a transaction carried out by a customer with a payment card, the Seller will make the return to a bank account assigned to the Ordering Party’s payment card.

Clause 11 Complaint

  1. A Contract of Sale covers new Products.
  1. Each Product purchased in the Shop may be complained about.
  1. To submit a complaint, you need to have a proof of purchase and inform the shop via electronic mail.
  1. A complaint will be considered within 14 days from the date of lodging it. A Customer will be notified about the result of a complaint by electronic mail or by phone.

Clause 12 Out-of-court methods of handling complaints and pursuing claims

  1. Detailed information on the possibility of using by a Consumer out-of-court methods of handling complaints and pursuing claims as well as the principles of access to these procedures are available in the registered offices and at websites of county (city) consumer ombudsmen, social organisations which statutory tasks include consumer protection , Voivodeship Inspectorates of Trade Inspection and at the following addresses of the Office of Competition and Consumer Protection: http://www.uokik.gov.pl/spory_konsumenckie.php; http://www.uokik.gov.pl/sprawy_indywidualne.php oraz http://www.uokik.gov.pl/wazne_adresy.php.
  1. A Consumer has the following example possibilities of using out-of-court methods of handling complaints and pursuing claims: 
    1. A Consumer shall be entitled to apply to the permanent consumer arbitration court referred to in Art. 37 of the Act on Trade Inspection of 15 December 2000 (Journal of Laws of 2014, item 148, as amended), for resolution of a dispute arising out of a Contract concluded with the Seller.
    1. A Consumer shall be entitled to apply to Voivodeship Inspector of Trade Inspection, pursuant to Art. 36 of the Act on Trade Inspection of 15 December 2000 (Journal of Laws of 2014, item 148, as amended), for instituting mediation proceedings in the matter of amicable resolution of a dispute between a Consumer and the Seller.
    1. A Consumer may obtain free assistance in the matter of resolution of a dispute between him/her and the Seller, also by benefiting from free assistance of a county (city) consumer ombudsman or a social organisation which statutory tasks include consumer protection (among others the Consumer Federation, Association of Polish Consumers).

Clause 13 Personal data in the online Shop

  1. The controller of Customers’ personal data collected through the online Shop is the Seller.
  1. Customers’ personal data collected by the controller through the online Shop is collected to perform a Contract of Sale, and, if a Customer expresses permission for it, for marketing purposes.
  1. Recipients of personal data of Customers of the online Shop may be:
    1. In case of a Customer who uses the delivery method by post or courier service, the Controller provides collected personal data of the Customer to a selected carrier or an agent delivering parcels by order of the Controller.
    1. In case of a Customer who uses the electronic payment method or the payment method by a payment card, the Controller provides collected personal data of the Customer to a selected entity handing above payments in the online Shop.
  1. A Customer shall have the right to access the content of his/her data and correct it.
  1. Provision of personal data is voluntary, but failure to provide personal data indicated in the Regulations which are necessary to conclude a Contract of Sale results in the lack of the possibility to conclude the contract.

Clause 14 Final provisions

  1. Contracts concluded by the online Shop are concluded in the English language.
  1. The Seller reserves the right to amend these Regulations for important reasons such as: amendments to the laws, changes of payment and delivery methods – within the scope in which these changes affect the implementation of the provisions of these Regulations. The Seller will notify a Customer about each change at least 7 days in advance.
  2. To matters not settled in these Regulations the commonly applicable provisions of the Polish law shall apply, in particular of: the Civil Code; Act on Provision of Services by Electronic Means; Consumer Rights Act, Personal Data Protection Act.
  1. A Customer shall have the right to use out-of-court methods of handling complaints and pursuing claims. For this purpose, he/she may file a complaint through the European ODR platform available at the address: http://ec.europa.eu/consumers/odr/.
